The terms and conditions apply to all forms of holiday treks, tours, and activities. These terms also govern the traveller's relationship with Destiny Excursion. We encourage travellers to read all of the terms and conditions mentioned carefully before proceeding.
When a booking is made, the designated lead traveller confirms that they have the authority to accept these Terms and Conditions on behalf of all individuals included in the booking. Upon receiving the booking request and the necessary payments, Destiny Excursion Pvt. Ltd. will issue a confirmation invoice, provided the requested arrangements are available.
A legally binding agreement between Destiny Excursion Pvt. Ltd. and the traveller will be established once the confirmation invoice is issued and dispatched to the lead traveller. This contract is governed by the laws of Nepal and is subject to the exclusive jurisdiction of the Nepalese courts.
It is the responsibility of the lead traveller to carefully review all details on the confirmation invoice upon receipt. For late bookings, this review must occur at the time of booking. Any discrepancies must be reported immediately, as changes may not be possible at a later stage.
After a booking is confirmed, any changes or modifications to the travel arrangements—subject to Clause 8—will be governed by these Booking Terms and Conditions. These will apply from the moment the amendment is confirmed.
These Terms and Conditions are applicable to all travellers listed in the booking. The lead traveller is responsible for ensuring that each member of the party has been informed of and understands these conditions. It will be assumed that all travellers have read and accepted the Terms and Conditions.
Only Destiny Excursion Pvt. Ltd., the lead traveller, and the travellers named in the booking have the right to enforce the conditions outlined in this agreement.
The lead traveller making and paying for the booking must be at least 18 years of age at the time of booking.
We at Destiny Excursion Pvt. Ltd. are dedicated to maintaining accurate and up-to-date information on our website, including pricing and package details. That said, occasional errors are inevitable. Thus, it is the responsibility of the traveller to verify the final price and all of the specific details of the chosen travel arrangements at the time of booking upon receiving the official confirmation invoice.
It is the sole responsibility of each traveller to make arrangements for possession of all necessary travel and health documents prior to departure. This includes compliance with all requirements for entry into a foreign country. A valid passport is necessary. Tourist visas for Nepal can be obtained upon arrival at Tribhuvan International Airport or through a Nepalese Embassy in the traveller's home country. By confirming a booking with Destiny Excursion, the traveller confirms possession of a valid passport for the duration of the trip.
Passports must be valid for at least six months from the date of return travel in most nations. If a passport is about to expire, the traveller must consult the concerned embassy. Further details on visa requirements can be found at:
It is every traveler's own responsibility to check and follow all the passport, visa, health, and immigration laws relevant to their travel. Destiny Excursion Pvt. Ltd. can provide general information, but the travelers must consult the respective embassies or consulates to confirm requirements relevant to their case. Requirements do change, and thus the travelers must check prevailing regulations well in advance of travel.
It is recommended that travellers consult with a medical professional for up-to-date advice on vaccinations and health precautions based on the destination(s) being visited or transited through. Destiny Excursion accepts no liability for denied entry or travel disruptions resulting from a traveller's failure to obtain or present the required passport, visa, health certificate, or other documentation as required by any airline, government authority, or destination country.
It is the responsibility of each traveller to ensure that they are medically fit to travel and that all of the health entry requirements of the destination are met in full. This includes taking all prescribed vaccinations, inoculations, and medications and following all medical advice relating to the destination(s) being visited.
We will not be responsible if a traveller is denied admission to any country or destination due to their failure to meet the health requirements, i.e., incomplete vaccinations or required medical documentation.
It is a compulsory requirement that all travellers, children, and infants are suitably insured for the entire duration of their holiday with Destiny Excursion Pvt. Ltd., It is the individual responsibility of each traveller to arrange travel insurance to cover their personal requirements and every part of the journey, but not limited to, medical expenses, baggage, cancellations, and any special interests or car hire involved. A copy of the policy is to be produced prior and taken on the trip.
If a booking is transferred to a different traveler, the original travel insurance will not be passed on.
The new traveler will be required to buy their own insurance that fulfills these booking terms.
We strongly recommend that all clients take out a comprehensive travel insurance policy covering cancellation fees, emergency and repatriation costs, medical expenses, loss or damage to luggage and personal effects, and any activities or excursions, especially in treks and locations involving adventure or high-risk activities such as helicopter rescue or extreme sports.
We at Destiny Excursion provide complete financial protection for all our package holidays in compliance with Nepalese travel regulations. We are fully licensed and are a recognized member of NTB (Nepal Tourism Board), TAAN (Trekking Agencies Association of Nepal), and NMA (Nepal Mountaineering Association).
If a confirmed booking is cancelled 30 days or more before the start of the trip in Nepal, a full refund shall be issued, with the exception of applicable bank charges and minor administrative fees. For cancellations made within 7 days of the trip’s start date due to emergencies, a specific percentage of refund shall be processed, which also excludes bank and admin charges. For trips booked in Bhutan or Tibet, cancellations made more than 7 days prior to the start date will also qualify for a specific percentage of refund, with the exception of any relevant fees.
Cancellations made within 7 days of the package start date shall not be eligible for any refund, as preparations and payments to service providers would already have been finalized.
Destiny Excursion Pvt. Ltd. accepts payments via cash, credit/debit cards, bank transfers, and online payment platforms. To confirm a booking, a specific percentage of the deposit of the total package price is required. This deposit is subject to the terms outlined in previous clauses and shall be clearly communicated at the time of booking.
For bookings made within 7 days of the trip’s departure date, full payment is required at the time of booking, preferably via credit card. The remaining balance for all other bookings must be paid no later than 7 days prior to departure. Failure to make full payment by the due date may result in the cancellation of the booking, and cancellation charges as specified in previous clauses shall apply.
Incomplete or incorrect billing information, including mismatched addresses or cardholder details, may delay or prevent the confirmation of a travel package. Destiny Excursion Pvt. Ltd. reserves the right to cancel any booking if payment is declined or if inaccurate credit card details are provided.
To safeguard against fraudulent transactions, random verification checks may be conducted. This may involve requests for supporting documents such as proof of address, a copy of the credit card used, and a recent bank statement before a booking is confirmed.
Should any fraudulent activity or payment irregularity be suspected or reported in connection with a booking, Destiny Excursion Pvt. Ltd. reserves the right to cancel the booking immediately. In such cases, the traveller will be responsible for any associated costs or losses incurred. Legal action may also be pursued where necessary.
Should a traveller wish to make changes to an existing booking after a confirmation invoice has been issued, we shall make every effort to accommodate the request. However, changes are subject to availability and can involve additional charges. All amendment requests must come from the lead traveller listed on the booking and must be submitted in writing, either by email or postal mail, to our official contact address.
If changes can be arranged, the traveller shall be responsible for covering any extra costs incurred as a result of the modification. Should our third-party suppliers charge higher administration or service fees, these shall be passed on accordingly.
A booking can be transferred to another individual who meets the original booking criteria, provided written notice is received at least 15 days before the departure date.
Requests for name changes within 48 hours of departure shall not be guaranteed. This is because most airlines do not allow name changes once tickets are issued, and in such cases, the full cost of a new ticket may apply. If it is intended that all names on a booking should be changed, this will be treated as a rebooking and cancellation, whereupon full cancellation fees apply.
In the event of any issue faced by a traveller during the journey, it must be intimated to our local agent and the relevant service provider at once. A report form should be completed at the destination. If the issue remains unresolved, travellers are encouraged to contact Destiny Excursion directly using the emergency contact details provided in the travel documents.
Should the matter not be resolved during the trip, a formal complaint must be submitted within 28 days of returning home. It is possible for tourists to contact our office by phone at +1 (914) 745-7175 or by email at info@destinyexcursion.com, supplying the reference number and all necessary details to allow for the resolution process to be carried out.
It should be noted that it is also vital to report issues while on tour. Not reporting issues while on tour can limit Destiny Excursions attempt at investigating and resolving the matter and may influence eligibility for compensation or refund.
If the traveler finds himself in trouble during the holiday and requires assistance, Destiny Excursion shall provide the assistance in a befitting way. This will be through helping the traveler to access local medical centers, authorities, and consular services or facilitating them with alternative travel arrangements and contacts. Any expenses incurred due to the traveler's own willful actions or negligence, however, will be paid by the traveler.
Passengers are obliged to notify Destiny Excursion immediately if any part of the travel services is not delivered as expected. If the issue seriously impacts the enjoyment of the trip, the passenger may be qualified for a price reduction, compensation, or both.
Destiny Excursion guarantees that all holiday arrangements are carried out with reasonable skill and care. Should a failure to meet these expectations occur which results in personal injury, death, or deficient services, Destiny Excursion shall accept responsibility, given that the failure is due to the actions or negligence of our team or authorized suppliers. But due to the adventurous nature and rugged terrain of Nepal, Destiny Excursion will not be held liable for personal injuries or accidents incurred during treks, expeditions, or other risk-exposed activities.
When organizing services like accommodations, transportation, or car rentals, Destiny Excursion undertakes the responsibility of exercising reasonable skill and care in deciding on reputable suppliers and making reservations. Liability is limited to errors occurring in the process of organizing and securing such services.
Destiny Excursion will not be held responsible for issues caused by:
Unless stated otherwise, our responsibility at Destiny Excursion is limited to the terms under Nepalese travel regulations. Travellers must demonstrate that we failed to act with reasonable skill and care to establish a claim.
For claims relating to loss or damage of personal items (including cash), our maximum liability is NPR 5,000 per person unless a different limit applies by law. For other claims not involving injury or death, our liability is capped at three times the total cost (excluding insurance and changes) paid for the trip by the affected traveller (s), assuming no benefit was received.
Travellers acknowledge and accept that all services are subject to the conditions of the individual providers, which are incorporated into these booking terms.
Destiny Excursion does not assume liability for activities, excursions, or events booked independently by the traveler during the trip, or through third-party concierge services. These are considered separate arrangements with the provider of the event, and any issues arising are the sole responsibility of that provider. This exclusion includes all high-risk or hazardous activities not organized directly by Destiny Excursion.
If any special needs (e.g., dietary needs, room type) are required by a traveller, they should inform Destiny Excursion at the time of booking. We will strive to pass on the request to the responsible service providers but cannot guarantee that it will be met. The inclusion of a special request on the booking confirmation or other documents does not confirm acceptance unless explicitly stated by Destiny Excursion. We are not liable for any unmet requests unless specifically agreed in writing.
Should the traveller or any member of their group have a disability or medical condition or require specific assistance, it is essential to inform us during the booking process. Some accommodations, particularly in remote or mountainous areas, lack basic accessibility features such as ramps or elevators. Destiny Excursion will be happy to help the traveler select an appropriate trip based on their needs. If we discover that we are not in a position to safely or reasonably accommodate the needs of the traveler, we can refuse or cancel the booking.
For hiking, mountaineering, and other demanding trips, pregnant travellers who are over 24 weeks pregnant at the time of travel may not be able to go on these trips for safety reasons. Pregnancy should be made known at the time of booking. Not doing this can lead to the contract being cancelled due to misrepresentation, and the lead traveller on the booking will be responsible.
Although Destiny Excursion takes the utmost care of its travellers and their belongings, we cannot accept responsibility for the loss or damage of personal items or for any injury sustained during the trip unless caused by proven negligence on our part.
Any personal information provided by the traveller during the booking process will be used solely for arranging the trip. Destiny Excursion does not share the traveller’s details with third parties not involved in the booking. Information submitted via our website or email will only be stored for the duration necessary to process the traveller's arrangements. For further details, please check our privacy policy.
Depending on weather, terrain, and group size, Destiny Excursion may use cars, vans, minibuses, or other suitable transport vehicles. Requests for a specific type of vehicle can be made but are not guaranteed. We reserve the right to work with licensed transport subcontractors when necessary. All trips are accompanied by English-speaking guides unless otherwise stated and typically start and end in Kathmandu, Nepal.
All price quotes include accommodations, driver and guide services, and their respective expenses unless otherwise stated. Prices generally do not include personal expenses, meals in major cities (like Kathmandu, Pokhara, or Lumbini), alcoholic beverages, tips, or any other items not listed under the “includes” section of the traveller's chosen package.
Prices are based on two travellers sharing a twin room, tent, or teahouse lodging. Where possible, rooms with attached bathrooms are arranged. Single occupancy is available at an additional cost but cannot be guaranteed during peak seasons. As Destiny Excursion specializes in premium travel experiences, accommodations in cities like Kathmandu will typically be arranged in 4 to 5-star hotels or resorts unless the traveller requests a different category during booking.
Destiny Excursion reserves the right to make changes to the terms and conditions outlined in this agreement. If any significant amendments are made that affect the traveller's booking, they will be notified in writing or via email prior to departure. Any changes made after the booking has been confirmed will only apply if the traveller agrees to them in writing. The traveller’s continued use of our services after such changes are made will be considered as acceptance of the revised terms.
In cases of unforeseen circumstances, such as changes in laws, regulations, or industry standards, Destiny Excursion may revise these terms to ensure compliance. Should such revisions result in a significant alteration of the traveller's booked itinerary, we will inform the traveller and offer alternative options or the opportunity for a refund.
